2. Eligibility and accounts

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for maintaining the confidentiality of your login credentials and API keys, and for all activity under your account. Notify us immediately if you suspect unauthorized access.

3. Plans, payment, and refunds

Plan pricing, outcome quotas (searches, verified emails, chat messages), and included features are described on the pricing page. Paid plans auto-renew monthly or annually until cancelled. You can cancel at any time from your billing page; cancellation takes effect at the end of the current billing period. Except where required by law, fees are non-refundable.

The free plan is a one-time trial allowance. The allowance does not refill and is not convertible to cash or credit on a paid plan.

4. Acceptable use

You may use the Service only for lawful B2B prospecting and outbound communication in your own name or on behalf of an organization you represent. You agree not to:

• Send spam, unsolicited bulk email outside the scope of applicable law, or deceptive messages.
• Target consumers for non-business purposes, or scrape contact information for resale outside the Service.
• Attempt to reverse-engineer, resell, or sublicense the Service without our written consent.
• Probe, scan, or test the vulnerability of the Service except through our security reporting process.
• Use the Service to build a directly competing product, or to train a machine-learning model whose primary purpose is to reproduce the Service.
• Circumvent plan quotas, rate limits, or billing.

You are solely responsible for the content and compliance of emails you send via Wowere, including compliance with CAN-SPAM, GDPR, ePrivacy, CASL, and other laws that apply to commercial email in your jurisdiction and the recipient's jurisdiction. You must honor opt-out and erasure requests you receive.

5. Send-only email scope

If you connect a Gmail or Outlook account, Wowere requests only a send-only scope. We do not read your inbox, threads, labels, or reply history. This limitation is a permanent product commitment, not a configuration option.

6. Your content and data

You retain ownership of the lists, campaigns, and outbound content you create in the Service. You grant us a limited license to host, process, store, and display that content solely to operate the Service for you. Enriched contact data returned from our data providers is licensed to you for your own prospecting use and may not be resold or redistributed as a standalone dataset.

7. Service availability

We aim for high availability but do not guarantee uninterrupted access. We may perform maintenance, update features, or change third-party providers, any of which may temporarily affect the Service. We are not liable for downtime caused by third-party providers, force majeure, or factors outside our reasonable control.

8. Disclaimer of warranties

The Service is provided “as is” and “as available.” To the maximum extent permitted by law, Wisepunk disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and the accuracy or completeness of any contact data returned. Verified emails are best-effort; we do not guarantee deliverability for any particular recipient.

9. Limitation of liability

To the maximum extent permitted by law, Wisepunk's aggregate liability for any claim arising out of or relating to the Service is limited to the fees you paid us in the twelve months preceding the claim. Wisepunk will not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, or lost data, even if advised of the possibility.

10. Indemnification

You agree to defend, indemnify, and hold harmless Wisepunk and its officers, employees, and agents from any claim, cost, or damage arising out of your use of the Service, your content, or your violation of these Terms or applicable law, including claims brought by email recipients.

11. Termination

You may stop using the Service at any time. We may suspend or terminate your account if you violate these Terms, put the Service or other users at risk, or fail to pay fees when due. On termination your right to use the Service ends and we may delete your data as described in the privacy policy.

12. Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law rules. The exclusive venue for any claim not subject to arbitration is the state or federal courts located in Wyoming, and each party consents to personal jurisdiction there.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified by email or in the product at least 14 days before they take effect. Continued use of the Service after the effective date means you accept the revised Terms.
